With this occurring it is believed that Inflection will contact some of our membership in an attempt to connect county property to their current leasehold in the Town of Maine area. We believe that they will contact individual owners to split from the coalition in order to obtain their goal. Inflection is not interested in leasing our entire coalition as they are a smaller outfit and do not have the resources to complete a transaction for our entire group. We have heard that they have already started contacting members but no offers have as of yet been reported back to us .

Senator Antoine Thompson made the statement that he doesn't believe we should rely on the DEC and that The new Governor should have time to get adjusted prior to dealing with this matter - Senator Thompson in making this statement that our Goverment should shut down for 6 months prior to and 6 months after an election to give time for adjusting. This bill would ban any hydrofracing activity in NYS for one year.Should this bill become law, the proposed one year moratorium, would, in fact, likely be two-to three years, and its certain that any gas company who might be waiting for the DEC to release the regs, would give up & head elsewhere.

Jun 13th - First we would like to thank all those who attended the rally in Albany last week your support is appreciated - We have just received information that the Senate Enviro Committee is trying to put a bill in that would institute a moratorium on drilling for another year - if this bill becomes law it is possible that any companies that are currently attempting to negotiate contracts for leases may pick up and leave - There is no reason for this moratorium all information be presented is based on opinion of a few obstructionists and not scientific fact - I have sent out an email with who to contact to voice your opinion on this bill - if you are a member of our coalition and are not receiving emails please email us at info@centralbroomeassociation.org to correct this issue

Oct 13-2009 The steering committee has heard rumors that Llama is trying to convince area landowner to sign brokerage contracts. We understand the terms of the offer to include a payment to Llama of 20% of any amount over $5,750 an acre and a 20% share of your royalty for any royalty over 20%. Please understand that Llama is not making a commitment to pay bonus or royalty. They are only committing to shop for lease offers from other companies while locking up landowners in an exclusive arrangement. You should also understand that $5,750 is not a new proposal. Friendsville closed at $5,500 an acre. It was immediately beat by other companies with offers of $5,750.
The steering committee believes the Llama proposal is a bad deal. You should never give away a percentage of your royalties in any deal. We believe this contract gives Llama the exclusive right to negotiate for your property for a period of time which can be extended up to 90 days. You would not be able to make a deal with another company during the period of the contract. Please refer to the royalty calculator below to estimate how much you will be paying annually for every ten acres of land you own in a 640 acre unit that is producing 3mmcf a day and gas prices at $6 - the amount in the calculator turns out to be $1,026.56 annually - the figure of 3mmcf is low for a 640 acre unit therefore you will be paying thousands of dollars by giving away 1% of the royalties during the life of the lease which can continue indefinitely. There are also companies that are out just trying to sign landowners for leases at top dollar with Gas Company leases and although this money is tempting it gives you little or no protection for your property. Just remember why you joined a coalition and the work that the steering committee is putting in for you. We are trying to negotiating the best deal for all and are asking for nothing in return but your patience. Furthermore, we have no financial interest in the process other than trying to maximize the offers for our properties and yours.
Most local coalitions have rejected any proposals to sign broker agreements. Gimmicks like the Lease Auction House and the exclusive broker agreement Kirkwood signed earlier this year have all failed. The basic concept of the coalitions has been that landowners are only committed if they like the deal proposed by the coalition. The same should be true for Llama or any other company. Let them bring an actual deal to the table and then you can decide whether to accept.
We urge you to avoid any proposals based on the promises of a broker with a financial interest in getting you to sign an exclusive agreement. As always, please feel free to contact any of your steering committee members if you would like to discuss this further.

July 16, 2009 - Plans are under way for a seven county Southern Tier landowners rallyto be held on Sunday, Augest 23 at the Bainbridge Regatta groundsbetween noon-5PM. The Theme of this rally is OUR LAND, OUR RIGHTS, OURFUTURE. The rally's purpose is voice the landowners' concerns that gasdrilling is being impeded by the undue DELAY of the DEC updatedregulations. Marcellus Shale Road Show Presentation Cornell Cooperative Extension (CCE) is hosting a series of public meetings across New York's Southern Tier this summer to educate residents about issues associated with the development of natural gas production in the Marcellus Shale. On Wednesday, July 22, 2009 at 7:00 p.m. in the Community Room at the Chenango Town Hall members of the Cornell Cooperative Extension Marcellus Shale Team will host a presentation on natural gas development. The presentation is intended for the general public and will provide a basic but comprehensive overview of the community and economic development, environmental, regulatory, and leasing issues associated with gas development. There is no charge for attending the presentation, but please call (607) 584-9966 to register because seating is limited. The event is sponsored by the Cornell Cooperative Extension Marcellus Shale Team and Cornell Cooperative Extension of Broome County.
July 11, 2009 - WE are going to need the assistance of all members on two occasions, the first will be a letter writing campaign to our officials and the second is on August 23 to attend a rally that is in the planning stages. It is very importatnt for all members to assist in these matters to show Gov't officials where we stand - Things appear to be picking up a little - we are currently receiving a showing of interest from a couple companies - we have to work out some logistics prior to actually entering into any type of negotiations such as confidentiality agreements and such. Several of us travelled to Albany and met with personnel from the Governor's office and DEC. We were advised by the DEC that the Draft SGEIS will be out in the beginning of Sept, and that the process should be completed by the end of the year.
June 17th, 2009 - Hello to all - As most of you have read the Town of Binghamton, Conklin and Kirkwood all have offers on the table. We currently are advised by our attorneys that things are starting to pick back up as these companies appear to be working from the state line up. There is several companies who are inquiring into our membership. We also have been been meeting with the joint coalition which is compromised of approximately 24 different coalitions to keep informed of all activity and go over issues that may arise in different areas. The joint coalition was initiated by our coalition steering committee. With the companies returning with new offers we expect that our wait will be well worth it and we will be able to settle on a safe contract.
April 24 - Please be aware that there are currently various companies offering landowners assistance with oil and gas leases and pipeline easements. We suggest that you consult with your attorney or call your coalition steering committee prior to entering into an agreement. Some of these agreements may adversely affect your ability to participate in our pending or future lease negotiations. These agreements may contain wording that would prevent you from signing a coalition lease even if you refuse the offer presented to you pursuant to the agreement.

Jan 15th - 2009 - The Governor will be coming to the Binghamton area on Feb 4th - we would like to have as many people as possible available to show support in favor of safe Gas Drilling and to push the DEC along in completing the Scoping document - the times and locations of the Governor's visit have not yet been released - further information will be forwarded when available - ALSO as a reminder again gas companies are working their way into the area in an attempt to secure leases for gas lines - currently in the Chenango county area they are signing leases for this purpose to get gas from the wells to the transmission lines (Millenium Pipeline) - these leases have no expiration date and are very complex in nature - we urge you to contact legal advise prior to signing these leases - currently we are working with the Oxford coalition (currently involved with this type of leasing) along with the other coalitions in the area to have a informational meeting in regards to this - thanks again for your patience
JAN 12-2009 - Hello to all - we hope everyone enjoyed their holidays As you all have noticed things have been going slow and some may have noticed that Kirkwood had entered into an agreement - This agreement is _*not a lease*_ deal with an oil and gas company. This is a marketing agreement - the consultant now has to get a oil and gas company to agree to these terms and finalize the deal within a specified time frame.
The New York State DEC Draft Scoping Document is due out in the next week after this is released it will have a 90 day review period prior to the final documents release, which again will have a 90 day review period. It is anticipated that leasing options will start to increase with the release of the draft document as it will indicate to the oil and gas companies what NYS is looking at as far as regulations go. We currently do have several companies that are interested in
Our Steering committee has been meeting and will continue to meet with members of other steering committees throughout the area. Members from the Chenango County area has brought up the point of pipeline leases that have been being marketed in their area in full force. These are the pipelines that go from the wells to the main transmission line - these leases are separate from drilling leases and should be treated in the same manner as a drilling lease as they affect your property forever.
Nov 6, 2008 Hello to all. The steering committee has been meeting with steering committees from other coalitions recently in an effort to discuss the state's stance on drilling issues. The main consensus among all is that we need to contact our local and state politicians and advise them that we have already investigated the effects of the drilling and cover issues that arise from drilling in our leases. Further that the state should keep on schedule with their DEC Scoping document to give the gas companies the ability to come in and drill. We along with other steering committees have met with members of the IOAGA - (Independant Oil and Gas Association) in an effort to answer questions regarding the environmental problems being brought forward by certain environmental groups. The main issues that arise are water usage and disposal, water pollution, land pollution, light and noise pollution, caused by drilling. The problems that these goups bring forth are issues that have arisen in areas where a shallower well is drilled into coalbed methane gas which is only a few hundred feet below the earths surface and at the same levels or near the depths of aquifers. This is a different procedure utilizing different technoligies and in a different geological formation. This is not the case here, we are talking about drilling depths in excess of 4000 feet into a shalebed. The other issues that we have discovered that is arising is that local municipalities are looking at imposing unrealistic fees and guidelines for the companies. Local gov'ts must take into consideration that imposing too strict of regulations and unruly fees will deter companies from doing business here and that will cost you as tax payers money. Goverment needs to know that the economical impact of the gas companies will far exceed any income imposed by flat fees and permitting costs. This is why it is very important that we all contact our legislators and advise that we are in support of the drilling in New York State and that we do believe it can move forward in a safe and eqiutable fashion for all to benefit. thank you
We have received responses from several companies showing an interest in negotiating a lease with our association. There also have been responses from companies stating that due to the New York's stance on horizontal drilling that they currently are not seeking new leases until the scoping document from New York state is complete. We are currently in the process of entering into confidentiality agreements with the interested companies and then negotiations on the lease will begin. During this process some may be contacted by Landman in an attempt to lease your property this is where your patience may really be tested. The process is moving forward and we are optimistic that we will negotiate a good lease. Further we have put some letters on the web site for members to send into gov't officials showing our concerns for moving in a forward motion to allow Horizontal drilling in New York State.
I would first again like to thank everyone for your patience in this endeavor - We are currently in the process of completing the list of companies to which we will be submitting letters of interest to. These letters will be sent out with confidentiality notices within the next week. This is the first step of the bidding process. During the next several weeks we will gather the information obtained from these companies that show a sincere interest and forwarding them additional information on the group. I would like everyone to keep in mind that once we start sending out information on what parcels we have that some companies may send landmen back into the area in an attempt to get people to sign seperate from the group.
